ONLINE AUCTION TERMS AND CONDITIONS Before Placing a Bid, please read the entire following Terms and Conditions: Music City Auction (hereinafter referred to as MCA) is located at 5530 Clarksville Pike, Joelton, TN 37080. ONLINE TERMS AND CONDITIONS Your participation in this auction binds you in agreement to the following Terms and Conditions, whether or not you have read or understand said terms. 1) All Bidders must be at least 18 years of age to participate in this online auction. 2) All items are sold "AS IS, WHERE IS." Items are available for intense public inspection. It is the Bidder's responsibility to determine age, condition, quality, authenticity, realness, uniqueness, genuine aspect value or any other physical characteristics. MCA will attempt to accurately describe the merchandise, through the use of photographs and descriptions. However, MCA makes no representations or warranties of any kind. Under no circumstances shall MCA be held responsible for having made or implied any warranty of condition or for any particular use or purpose. Bidder shall be the final, individual judge of item's value. All information provided by MCA is submitted in good faith. 3) ONLINE ONLY AUCTION BIDDING: Bidders understand and agree that they are bidding over the internet and technical issues may occur. MCA has no control over and is not responsible for any bid that fails to be recorded. This is especially relevant near closing times due to high volume. MAXIMUM BIDS- When a maximum bid is placed, the current bid price does not automatically proceed to your maximum bid. Another bidder must bid to increase the current bid. Your bid will automatically increase to the next bid increment. This process will continue until you have either been outbid or have successfully won the item. MCA strongly suggests that you take advantage of the maximum bid feature, as this will provide additional coverage that your highest/best bid has been recorded. EXTENDING BIDDING FEATURE- This auction features EXTENDED BIDDING. Any lot that receives a bid within 3 MINUTES of its scheduled closing time will remain open for bids past the scheduled closing time and will then enter into an EXTENDED BIDDER PERIOD. This feature only affects those lots with last minute bids. All other lots will close at their scheduled times. The lot will remain open until there are no additional bids for a period of 3 MINUTES. ADDITIONAL BIDDING TIPS- Please remember to refresh your screen to determine if you have been outbid. To refresh, click on refresh for the whole page or use the refresh button on your browser. This is especially useful and necessary at the end of the auction. SIMULCAST BIDDING: All aspects of SIMULCAST BIDDING mirror ONLINE ONLY Bidding with the exception of the extended bidding feature. 4) A Buyer's Premium of 15%/10% will be assessed on each lot sold to determine the final sale price. If payment is with a credit card/debit card, then the Buyer's Premium will be 15%. If payment is with cash, check or other certified funds, then the Buyer's Premium is 10%. 5) Tennessee state sales tax of 9.25% will be assessed on each lot sold, unless indicated otherwise in the description of the item. TN state sales tax will be waived if successful bidder has submitted a valid tax resale number on file with MCA or if item is to be shipped outside of Tennessee. 6) All sales are final with no refunds or returns allowed. 7) This is an absolute auction. Each lot will be sold to highest bidder without reserve. 8) All sellers are prohibited from bidding on items that they have consigned to this auction. 9) PAYMENT: Successful Bidders must pay for their purchases in full at the conclusion of the auction. MCA accepts the following forms of payment: US currency, credit cards (Mastercard, VISA, American Express, & Discover), good personal and company checks (bank letter of credit may be necessary, unless bidder is known to MCA official). DECLINED CREDIT CARDS- Successful Bidders with credit cards that are declined on payment will be assessed a $30 processing fee to process an additional credit card. 10) Merchandise becomes the FULL responsibility of the bidder at the time of payment. Bidder assumes all risk of loss and damage of merchandise at time of payment. 11) PICK-UP: All items that have been paid for in full may be picked up at the MCA facility, located at 5530 Joelton TN 37080. Please contact MCA to set up an appointment for pick-up. Bidders are responsible for providing and preparing for removal, including the use of packing/moving materials, and loading of items without the assistance of MCA officials. Any items not removed from the facility by the designated removal date shall be considered abandoned property, and as such, MCA reserves the right to resell the items, keeping all proceeds as payment for unpaid storage and handling. 12) SHIPPING- Shipping services are not included in the successful bid price. Shipping may include additional charges to the Buyer. Please contact MCA to determine method and process of shipping. 13) Bidder agrees to pay all reasonable legal fees incurred by MCA in the unlikely event that litigation is necessary for any related bidding or relevant auction matter arising from the participation in this auction. Any auction matter shall be exclusively construed and governed in accordance with the laws of the State of Tennessee, without regard to its conflict of laws principles. The exclusive jurisdiction and venue of any controversy or claim between parties shall be the city of Nashville (Davidson County) in the State of Tennessee. THE BIDDER, BY PLACING ANY BID ON THIS AUCTION, AGREES TO ALL OF THE TERMS AND CONDITIONS OF THIS AUCTION.
