Description
Farm & Pature Ground located in Tripp County, South Dakota offering 949 Acres +/- at auction on April 23, 2018, 10:00 AM CST at the Holiday Inn Express, 1360 E Hwy 44, Winner, SD 57580. This will be a live off-site auction with online bidding available. Online bidders must pre-register with danclarkauctions.hibid.com. This farm is located from Winner, SD, 8 miles East on SD Hwy 44 and 11.5 miles North on SD Hwy 49. Both tracts 4 and 5 are located along SD Hwy 49. Tracts, 1, 2 & 3 are located 2 miles West of Sd Hwy 49 along a well mantained Tripp County gravel road. There will be signage marking the individual tracts. This 949 +/- acre farm will be offered in (5) individual tracts and NOT in any combinations. These properties will be sold by the acre, based on the acres as stated on the county tax records, with the acres understood to be "more or less".
Identification will be required to register to bid during this auction. Video and audio recording devices will be in use during the auction which may be broadcast via the internet or used in other places. This is a cash sale. Potential buyers must have their financial arrangements secured prior to bidding. There will be no buyer contingencies offered or accepted for financing, inspections, or appraisals. Successful bidder(s) will be required, immediately upon the conclusion of the auction, to sign a Real Estate purchase contract and to deposit with Dan Clark Auction & Realty, LLC, a ten percent (10%) nonrefundable earnest money payment, which will be made out to the closing agency, Tripp & Todd Title Company, 302 East 2nd Street, Winner, SD. Balance of the purchase price is due in certified funds at closing on or before May 31, 2018. In lieu of a previous lease agreement, Buyer (s) will become Landlord(s) at time of closing with the option to terminate current lease for the 2019 season. Landlord(s) would be required to notify lessee by legal written notice prior to September 1, 2018 to terminate current lease. All 2018 rent payments and all crop shares will go to the Buyer (s). Crop share expense from fertilizer and chemical will be billed directly to Buyer(s) from Country Pride of Winner, SD. Conveyance of Marketable Title will be transferred by South Dakota Trustee Deed, free and clear of liens but subject to easements, reservations, and exceptions of record as well as statutory rights of way and other recorded easements at the time of sale. Owners Title insurance policy will be provided to the buyer for examination prior to the auction. Cost of Title insurance and closing fees will be divided equally 50% buyer & 50% seller. This property is sold AS-IS / WHERE-IS. Property is being sold by legal descriptions only. Should a property survey become necessary, it will be at the buyer's expense. Seller(s) do not warranty or guarantee the property boundaries are accurate. Any new boundary survey will be the responsibility of the Purchaser, pursuant to South Dakota statutes. All mineral rights (if any) owned by Seller will be transferred to the Buyer(s).
