Saturday, December 31, at 10:30 AM MST. Bidding STARTS CLOSING on the first item at 10:30 a.m, then each subsequent lot is staggered thereafter in catalog order until bidding on all items has closed.

All items to be removed by Friday Jan 6th or be subject to storage fees of $25 per day, per item.

REGISTRATION
To gain access to the Auctioneer’s bidding system, you will need to register and obtain a bidder number. You must be eighteen years old or older to register. You agree that all information that you provide during the registration process will be true and accurate. You will be banned from participation in the Auctioneer’s auctions indefinitely, should you provide any false information during the registration process.
BUYER'S PREMIUM
5% Buyer's Fee added to bid for total purchase price
Example: $1000 bid + $50 BP = $1050 purchase price
3% Convenience Fee added IF payment made with credit card
AUCTION ENDING & SOFT CLOSE
Beginning at the stated closing time, the auction software will conclude bidding for one or more lots each minute in catalog order with the following exception: if a bid is placed in the last one (1) minute remaining for that auction lot, bidding for that lot will remain open for an additional one (1) minute.
OUTBID NOTIFICATION:
Until the auction begins to close, the bidding software will notify bidders by email when they have been outbid. Some lots will be grouped together so that a bid on one lot will extend the time on all lots in that group.
PAYMENT DUE
All buyers must pay for their purchases in full by Tuesday, Jan 3rd by 4 pm !!! No road reports - no weather conditions. In other words NO EXCEPTIONS.

Merchandise becomes the full responsibility of the buyer at time of payment and the buyer assumes all risk of loss and damage to property at that time. Musser Bros. Inc. reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property.
BIDDER'S DUTY TO INSPECT AND INVESTIGATE
You acknowledge that the Auctioneer is providing you with the opportunity to inspect the items being offered for sale in this auction. The Auctioneer strongly encourages you to attend the scheduled inspection for this auction, which will take place on the date listed above. If you choose not to attend the scheduled inspection or are in doubt about the condition, completeness, or suitability of a given item, please bid accordingly.

It is the buyer's responsibility to pay for the cost of packaging and shipping through preferred courier. PICKING UP YOUR ITEMS
You are solely responsible for the safe and timely pick-up and removal of any items you may win at this auction. If you are unable to safely pick up and remove your items during the removal times that have been scheduled for this sale, PLEASE DO NOT BID. The Auctioneer does not ship, nor does the Auctioneer hold items beyond the published removal times. The Auctioneer will not issue you a refund if you are unable to pick up and safely remove your items during the published removal times.
BIDDER'S DUTY TO REMOVE ITEMS SAFELY
Again, you are solely responsible for the safe pick-up, removal, and transportation of your items. You agree that the pick-up, removal, and transportation of your items will be solely at your expense and at your risk. You further agree that you will be responsible for any damage that you or any of your agents cause during any preview or removal period, and also agree that the credit card associated with your online account will be charged for any expenses incurred and/or repairs necessary as a result of any damage that you cause.
RELEASE UPON PRESENTATION OF RECEIPT
You understand and agree that the Auctioneer will release your items only after you or your agent presents a Paid in Full invoice generated by the Auctioneer stating that your account is paid in full. You further understand and agree that it is your duty to ensure that any agent picking up items on your behalf has a copy of your Paid in Full invoice to present at the pick-up location. You explicitly authorize the Auctioneer to release your items to any person in possession of your Paid in Full invoice. No item will be released to any person unless that person presents a Paid in Full invoice listing the item in question.
NO BUYBACKS
All consignors are prohibited from bidding on lots they have consigned to the auction.
ABANDONMENT
You understand and agree that any item that you do not pick up during the published removal times will be considered abandoned. You understand and agree that you may be charged a reasonable fee for the storage, removal, and/or disposal of any item that is considered abandoned.
DEBT COLLECTION AND INTEREST CHARGES
The buyer agrees to pay all reasonable attorney fees and other costs incurred by Musser Bros. Inc. in its efforts to collect unpaid funds from the buyer. The buyer agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due Musser Bros. Inc.. Any debt collection or dispute proceedings will be heard in Yellowstone County, Montana.
LIMITATION OF LIABILITY
If, for any reason, Musser Bros. Inc. is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Musser Bros. Inc., if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser.
DISCLAIMER
All lots sell as is, where is, with all faults. Musser Bros. Inc. and the seller do not give or make any type of guarantee or warranty regarding the lots to be sold, implied or otherwise. Musser Bros. Inc. encourages all bidders to inspect lots in person before bidding. Musser Bros. Inc. is not responsible for incorrect listing information, if any. Musser Bros. Inc. has attempted to provide accurate descriptions of all items, however, it is the bidder's responsibility to determine the condition and suitability of each lot. Printed statements or descriptions by Musser Bros. Inc. staff are provided in good faith and are matters of opinion.
AGE REQUIREMENT
All bidders must be 18 years of age or older.
BIDDER INFORMATION AND SECURITY
All registration information the bidder provides to Musser Bros. Inc. shall be current, complete, and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Musser Bros. Inc. if they believe that their bidder number and password have been compromised.
TIE BID OR UNCERTAINTY
In the event of a TIE BID or any uncertainty as to offered last and highest bid the Auctioneer has a right to resolve any such at the time by accepting the Bid that the Auctioneer believes is in good faith and was the last, highest and best bid. Auctioneer may open the bidding between the parties at his discretion and option and such decision will be final and binding on affected parties.
