All registering bidders agree for Houston's Auction Barn or it's subsdaries to use phone numbers and emails for future notifications of auctions, via phone robot call or email campaigns.
Terms and Conditions Please, read & understand ALL of our terms & conditions before bidding.
All items are offered for sale to the highest bidder and the bidders must establish to their own satisfaction the authenticity and condition before bidding. Our goal is to provide accurate descriptions for all items, but should not be construed as a guarantee in any means. It is the sole duty of our customers to make their final decisions regarding an items description, authenticity, materials, condition and value. Your decision to bid confirms that you have either previewed the items, or are in agreement to the conditions and terms listed above.
Deposit - Winning bidder MUST pay a $1000 dep via wire transfer, credit card or cash within 24 hours of receipt of invoice. NO CASHIERS CHECK
Full Payment - Full payment must be received via wire transfer or cash only within 72 hours of sale. If not the vehicle will be offered to the next highest bidder. NO CASHIERS CHECK
All sales are final, no refunds, no exceptions,

Shipping - Pick-up and delivery of the vehicle is the full responability of the purchaser
All items offered for sale in this auction will be offered for sale by auction only and there are no presales.
Bidding Increments will be followed throughout the auction without exception and is as follows:
$1000 - $5000 by $1000
$5001 - $10,000 by $500
$10,001 - $9,999,999 by $250
Buyer's Premium:
13% credit card
10% cash or wire transfer
Invoicing & Payments
Invoicing will follow after the auction is complete. Deposit must be paid within 24 hours of receipt of invoice. Balance due is payable within 72 hours of invoice receipt.
Texas Sales Tax is payable by all buyers liable to tax. All Dealers must provide a valid resale number upon registration and fill out a Texas Resale Card prior to bidding for Tax Exempt Status.
Consignors are not allowed to bid on their own merchandise or have any agent bid on their behalf. If the Auctioneer recognizes such bidding or is advised of the same he may withdraw any or all lots consigned by the offender and will publicly recognize that consignor.
Payment Info Payment Types accepted: Cash/Credit/Wire Transfer for deposit. Cash or wire transfer on balance due.
All efforts are made to make the catalog as accurate as possible, with no warranties expressed or implied.
THE ACCEPTANCE OF HIGH BID BY THE AUCTIONEER CONSTITUTES A LEGAL AND BINDING CONTRACT WITH THE BUYER AND ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE UNDER TEXAS STATE LAW.
Both parties agree that this is a legally binding contract and it is the responsibility of consignor to seek competent advice regarding these terms if not completely understood. The terms shall be governed by and interpreted under the laws of, and any action hereunder against Auctioneers shall be commenced in the State and County in which the auction occurs. In the event of any controversy or claim arising out of or relating to this agreement, or a breach thereof, the parties hereto shall first attempt to settle the dispute by mediation, administered by the [American Arbitration Association] under its [Mediation Rules]. If settlement is not reached within sixty days after service of a written demand for mediation, any unresolved controversy or claim shall be settled by arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The number of arbitrators shall be [one or three]. The place of arbitration shall be Houston, Texas. Texas law shall apply. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
In the event that either party in relation to this agreement brings suit after arbitration, the prevailing party shall be entitled to reasonable attorney's fees and court costs at trial or on any appeal. Seller also consents to jurisdiction in the circuit or district courts of Harris County Texas.
