All items offered for sale at the Auction ("Items", "Property", "Product", "Purchases") are subject to the following Terms and Conditions of Sale, which, combined with each Auction's specific terms as posted in materials and on the web, make up the Complete Terms and Conditions of Sale. Preview of Items: Preview inspections are welcomed and recommended, but items may not be removed from premises. Preview of items will be allowed only on the date/time set by Dudley's Auction Company. Those found tampering with items or inspecting without Auction Firm's authorization will be asked to leave the premises and may be subject to prosecution. Registration: All Bidders are required to be at least 18 years of age, have a valid government issued ID and a valid Debit/Credit card. The bidder's number is nontransferable. All bids made using the bid number will be the responsibility of the registered Bidder. Payment: Upon becoming a successful bidder at the conclusion of the auction, the winning bidder assumes full responsibility for purchases and agrees to pick up and pay for all items in full within specified pick-up dates. If bidder does not pay for and pick up items on specified pick-up date, alternate arrangements must have be made with the auction firm prior to the pick-up date. Otherwise, the winning bidders will be charged for the entire amount of their purchases plus applicable fees and bidders will relinquish all rights to items purchased. WINNING BIDDERS WILL BE INVOICED AND THE DEBIT/CREDIT CARD USED TO REGISTER FOR THIS AUCTION WILL BE CHARGED IMMEDIATELY FOLLOWING THE SALE. Accepted forms of payment include Visa/MasterCard/Discover/AMEX Please note: A 15% buyer's premium will be added to each purchase Failure to Remove Purchases: No refunds will be given for items not removed within said time frame. In the event items are not removed on specifid pickup date, the items purchased shall be deemed abandoned and Buyer will lose any right, title or interest Buyer may have acquired and the items shall revert and repossess to Auctioneer without further notice to Buyer. Auctioneer shall also be entitled to any costs associated with the removal, storage and reselling of Buyer's items, and any other charges, fees, and expenses incurred as a result of Buyer's failure, including all attorney fees and costs incurred by Auctioneer to enforce Buyer's obligations hereunder. "AS IS, WHERE IS": All items will be sold "AS IS, WHERE IS," with no warranties, expressed or implied, including, but not limited to the warranty of merchantability. Buyer agrees that items are purchased "With All Faults." The bidder is responsible for inspection prior to bidding. The auctioneer makes the final decision regarding the winning bidder on each item. All sales are final. NO REFUNDS. NO CREDIT CARD CHARGEBACKS. Auctioneer shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection therewith. On-site inspection of items being sold is recommended. Auctioneer makes every effort to provide accurate information about the items being sold. However, neither Auctioneer nor its Client will assume responsibility for Buyer's bidding errors. It is Buyers' full responsibility to confirm the accuracy of items offered for sale. Buyers are recommended to inspect all items. Descriptions and photos are offered as a guide only. Do not rely solely on photos to make buying decisions, be sure to read descriptions. Auctioneer shall not be held responsible for such errors as posting the wrong photo for an item. Dudley's Auction Company makes every effort to accurately represent all items which are advertised online. When in doubt about the condition of an item, please bid accordingly. Changes to items offered for sale: Dudley's Auction Company reserves the right to add, delete or modify information and photos prior to close of sale. Items are being sold with reserve, and therefore will not be sold if highest bid does not meet reserve pricing. Auctioneer's Refusal of Bids and Right to Bid: Dudley's Auction Company reserves the right to accept or reject any and all bids submissions. If a dispute should arise among two or more bidders, the decision of Dudley's Auction Company shall become final and absolute. Auction company employees may bid on items and will abide by the same terms and conditions set forth.
